The idea of introducing changes to the criminal process is totally well-grounded, and the proposed draft Criminal Procedural Code, regardless of its shortcomings, is more progressive than the one in force. MP Volodymyr Stretovych, member of the Christian Democratic Union Party's Board, stated that in the air of Era radio station.
Specifically, the MP drew attention to the fact that the defense obtained much more rights in the process of inquiry of experts in order to protect the accused.
At the same time, the MP is sure, a number of problems still remain, among which is increase of the prosecutor’s powers. “According to the article 36 of the draft law, the prosecutor can control the investigator, instruct him, and in case the prosecutor does not agree with conclusions of the investigator, he can write a verdict himself basing upon the evidences collected. There was nothing like that in the old code”.
“The VR of different convocations made attempts to change the Criminal Procedural Code and have several times been close to the new code’s adoption. The authorities’ will to change the situation was the only thing lacking. The improving of the law – together with the one of the laws “On Advocacy” and “On Prosecutor’s Office” – has been Ukraine’s obligation to the European council since 1995,” Stretovych said.
